The session will describe how various American States have recognised the Rights of Nature. It will depict the different legal approaches taken to bestow Mother Earth with Rights (constitutional framework, legal acts and judicial awards). Then, it will review whether the international arena has participated in the evolution of this set of rights. It will focus on the Inter-American Court of Human Rights´ Advisory Opinion “OC-23/17” about the Environment and Human Rights. Finally, it will contrast the Rights of Nature foundation (factual evidence, legal evolution and even some ancestral beliefs) with the wording given by the Court regarding environmental protection.
